Marlon Wayans Seeks Joint Custody Of Daughter Amid Legal Battle With Ex Brittany Moreland
Marlon Wayans is seeking joint custody of his 18-month-old daughter, Axl, amid a legal dispute with ex-partner Brittany Moreland. Marlon, 51, recently filed his response to Brittany’s petition for full custody, asking the court for joint legal and physical custody, as well as joint payment of legal fees.
In March 2024, Brittany, 34, filed a petition for full custody of Axl, requesting that Marlon be granted visitation rights. Marlon, who also has two children, Kai and Shawn, with ex Angela Zackery, signed a voluntary declaration of parentage for Axl on December 13, 2022, just one day after her birth.
Speaking with The Shade Room in March, Marlon addressed the legal filings and his relationship with his daughter. “All love, all God. The baby isn’t a secret. The mama has been posted. But I chose to keep the baby’s private life private,” he stated, adding, “Social media is toxic and dangerous, and I’d like to keep her peace.”
However, Marlon expressed his frustration with being labeled a “visitor” in his daughter’s life. “Do you pay all that money per month and be called a ‘visitor?’ Do the math. This is delusional. I will let the lawyers and God do what they do,” he told The Shade Room.
“I’ll be creating art from a broken heart. I got nothing but love. Even when it’s bad, it’s good…it’s GOD,” he added.
Brittany’s documentation states that Axl spends “95 percent of their time with me and 5 percent of their time with the other parent.”
Hence, she sought full legal and physical custody of her child while asking that Marlon be granted visitation rights. She also requested $2,000 per month in child care support from Marlon so she could continue working.
She further petitioned for “reasonable expenses of pregnancy and birth,” as well as for costs of litigation to be covered by the actor.
Marlon, however, addressed the child support requests in the paternity suit, calling it a classic case of entitlement. “It’s the classic case of a good, loving, responsible father shelling out over $18k per month for a one-year-old, and an entitled woman decides she wants more. My mama and dem would’ve lost their minds for $2k,” he said.
