Judge Denies Sia’s Estranged Husband Dan Bernad Sole Custody Of Their Son
Sia just had a small but significant victory in her ongoing custody battle. The Chandelier singer’s estranged husband, Dan Bernad, was denied his request for sole custody of their 19-month-old son, Somersault. A Los Angeles judge ruled this week that there wasn’t enough evidence to grant his emergency order, according to court documents obtained by PEOPLE.
“The court finds that sufficient exigency for the requested emergency relief has not been shown at this time,” the filing stated. It also noted that the pair had already agreed to a temporary custody arrangement on August 1, 2025, giving Sia primary custody of Somersault and granting Dan limited, supervised visits.
The decision came just days after Dan accused the Grammy-nominated artist of being “an unfit and unreliable parent struggling with substance abuse and addiction.” He also alleged that Sia rarely cared for their son directly and left “nearly all child-rearing responsibilities to a revolving team of nannies.”
But in her own court filing, Sia disputed every claim. “I have been fully sober for over six months and working my program which includes weekly testing and a sober companion,” she wrote. “My recovery has been a cornerstone of my life and one of the primary reasons I chose to separate from Dan, whose ongoing engagement in a nightlife and recreational drug-use lifestyle is incompatible with a healthy environment for our child.”
The 49-year-old singer added that her son “has always been in my primary care and custody,” claiming Dan “has never had custody of Summi for more than two hours at a time and [was] always monitored.” She pointed out that this was due to a prior criminal investigation involving him for alleged possession of child pornography (though she acknowledged that the case was closed without charges).
Even so, she said that outcome “does not appease my concerns of Summi spending unsupervised time with Dan.”
Dan, who claimed to be unemployed and without income, requested $77,245 per month in child support in addition to sole custody. He also asked that Sia pay all of their child’s medical, educational and childcare expenses.
Sia countered that his motives were not parental but financial. “To date, every request by Dan for additional custodial time has been directly tied to financial gain rather than a genuine effort to foster a meaningful parental relationship with Summi,” she wrote, revealing she had already paid him $300,000 since their separation in March.
The singer, who previously adopted two 18-year-old boys in 2019, has long been open about her sobriety journey and the changes she’s made in her life. This ruling gives her continued custody of her son as both parents prepare for further proceedings.
